Court vacates arrest warrant against Demsa LG chair

An Upper Area Court II sitting in Yola, has vacated an earlier bench warrant it issued for the arrest of the chairman of Demsa Local Government Council, Hon. Elkanah Kados Fwah.

The presiding Judge, Daniel John in Abdullahi Abubakar vs Hon Eldon Danjuma & Demsa Local Government Council said the court vacated the order after both parties appeared in court.

The Court had earlier issued an arrest warrant against the council chairman for non appearance in court.

Meanwhile, both parties have agreed to withdraw the case before court and resolve same through Alternative Dispute Resolution (ADR).

The complainant, Abdullahi Abubakar who decided to withdraw the case said his decision was borne out of the desire and determination to resolve the matter amicably out of court.

The complainant had earlier filed a complaint against the chairman Demsa Local Government Council, Hon. Elkanah Fwa for failing to pay a liability of N4.2 million being amount for a contract awarded to him for the construction of a block of 2 classrooms at Kpasham Primary School awarded by the previous council under Hon. Eldon Danjuma.
